Summit Log

1. Acceptance

These terms are an agreement between you and Fourteener Labs, LLC (“we,” “us,” or “our”) about the Summit Log application for macOS (the “App”). By installing or using the App you agree to them. If you don't agree, don't use the App.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Macs you own or control. You may not copy, modify, distribute, sell, rent, reverse-engineer, or create derivative works of the App except as permitted by law.

3. Your Credentials and Your Apple Account

The App works by connecting to Apple's App Store Connect API with an API key you generate in your own Apple Developer account. You are responsible for that key: keeping it secure, choosing an appropriate role for it, and revoking it if it may be compromised. Your use of the App Store Connect API through the App must comply with your agreements with Apple, including the Apple Developer Program License Agreement. The App acts on your instructions, under your credentials, on your behalf.

4. Independence from Apple

Summit Log is an independent tool. It is not affiliated with, endorsed by, or sponsored by Apple Inc. App Store, App Store Connect, and Mac are trademarks of Apple Inc.

5. Information Is a Convenience, Not a Record

The App displays information reported by Apple's APIs — review states, ratings, reviews, and sales figures. That information can lag, be revised, or be incomplete (for example, sales reports trail by about a day, and storefront ratings are per-country). The App is a convenience view; App Store Connect remains the authoritative record. Don't make irreversible business decisions on the App's display alone.

6. No Network Service

The App has no Fourteener Labs server or account. Apart from requests your Mac makes directly to Apple, the App does not transmit your data anywhere, and we have no ability to access, restore, or recover anything the App stores locally.

7. Updates and Changes

We may update the App, and these terms, from time to time. Apple also changes its APIs without notice; features that depend on an Apple endpoint may degrade or stop working until an update. The current terms will remain posted here with their effective date.

8. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that displayed information will be accurate or current.

9. Limitation of Liability

To the maximum extent permitted by law, Fourteener Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or related to your use of the App. Our total liability for any claim will not exceed the greater of the amount you paid for the App in the twelve months before the claim and USD $50. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

10. Termination

You may stop using the App at any time. We may terminate this license if you materially violate these terms. Provisions that should reasonably survive termination, including intellectual property, disclaimers, liability limits, and governing law, will survive.

11. Apple Terms

If you obtain the App through the Mac App Store, the App Store's standard terms, including Apple's Licensed Application End User License Agreement, also apply, and Apple is a third-party beneficiary of these terms with the right to enforce them.

12. Governing Law

These terms are governed by Colorado law, without regard to conflict-of-law rules. Courts located in Colorado will have jurisdiction, except where mandatory consumer law gives you additional rights or requires another forum.

13. Changes, Severability, and Contact

If any provision of these terms is found unenforceable, the rest remain in effect. These terms are the entire agreement between you and us about the App. Questions go to support@fourteenerlabs.com.
